Kant's reasoning in his special metaphysics of nature is often opaque, and the character of his a priori foundation for Newtonian science is the subject of some controversy. Recent literature on the Metaphysical Foundations of Natural Science has fallen well short of consensus on the aims and reasoning in the work. Various of the doctrines and even the character of the reasoning in the Metaphysical Foundations have been taken to present insuperable obstacles to accepting Kant's claim to ground Newtonian science. Gordon Brittan and Gerd Buchdahl, amongst others, have argued that Kant's stated aims in this case are not to be taken at face value, and that prior ontological commitments play a hidden but central role in Kant's special metaphysics. ;Michael Friedman has shown how Kant's stated aims can be taken seriously with his ingenious reconstruction of the Metaphysical Foundations as a demonstration of the a priori basis for our thinking bodies to be in true motion and in absolute space. However, Friedman does not address the issue of matter theory--despite the importance of the issue to Kant. I argue that a strict reading of both the stated aims and doctrines of the Metaphysical Foundations is possible, since much of Kant's reasoning about the empirical concept of matter can be explained by his views on how the construction of empirical concepts is possible. ;Kant's quasi-mathematical constructions are pivotal in Friedman's interpretation. Constructibility is Kant's criterion of acceptability for the concepts of natural science. Yet Kant notoriously fails to construct the dynamical concept of matter, and accepts this failure with an equally notorious complacency. I argue that Kant's criteria of empirical concept construction, apart from any prior ontological commitments, are enough to generate his views on matter. Kant's failure to construct the requisite concept of matter can be ascribed to a missing law of nature, a law of the relation of forces the discovery of which Kant thought imminent. I conclude that matter theory is central to the Metaphysical Foundations, but that this does not undermine Kant's stated aim of giving the a priori ground of Newtonian science. (shrink)

Kant's special metaphysics is intended to provide the a priori foundation for Newtonian science, which is to be achieved by exhibiting the a priori content of Newtonian concepts and laws. Kant envisions a two-step mathematical construction of the dynamical concept of matter involving a geometrical construction of matter’s bulk and a symbolic construction of matter’s density. Since Newton himself defines quantity of matter in terms of bulk and density, there is no reason why we shouldn’t interpret Kant’s Dynamics as a (...) defence of a Newtonian concept of matter. When Kant’s reasoning is understood in relation to his criteria for mathematical construction, it is possible to maintain that matter theory is central to the Metaphysical Foundations, but that this does not undermine Kant’s stated aim of giving an a priori foundation for Newtonian science. Kant's obscure essay entitled An Attempt to Introduce the Concept of Negative Quantities into Philosophy has received virtually no attention in the Kant literature. The essay has been in English translation for over twenty years, though not widely available. In his original 1983 translation, Gordon Treash argues that the Negative Quantities essay should be understood as part of an ongoing response to the philosophy of Christian Wolff. Like Hoffmann and Crusius before him, the Kant of 1763 is at odds with (...) the Leibnizian-Wolffian tradition of deductive metaphysics. He joins his predecessors in rejecting the assumption that the law of contradiction alone can provide proof of the principle of sufficient reason: -/- In his rejection of the possibility of deducing all philosophic truth from the law of contradiction, however, and in the clear recognition that this impossibility has immediate consequences for defense of the law of sufficient reason, Kant's work most definitely and positively constitutes a line of succession from Hoffmann and Crusius (Treash, 1983, p. 25). -/- The recognition that Kant's Negative Quantities essay is part of a response to the tradition of deductive metaphysics is, without a doubt, an important contribution to the Kant literature. However, there is still more to be said about this neglected essay. The full significance of the paper becomes known through its ties to a second, empiricist line of succession. Clues to this second line of succession can be found in Kant's prefatory remarks concerning Euler's 1748 Reflections on Space and Time and Crusius' 1749 Guidance in the Orderly and Careful Consideration of Natural Events. As I will show, these prefatory remarks suggest a reading of Kant's Negative Quantities paper that reaches beyond German deductive metaphysics to engage a debate regarding the application of mathematics in philosophy initiated by George Berkeley. I then discuss the general conditions for empirical hypotheses according to Kant, which include the justification of the method by which an empirical hypothesis is obtained and the establishment of the general and specific constructability of the (...) empirical concept. -/- *In Chapter II, I discuss the nature of the general construction of concepts which is treated in the Schematism of the Critique, surveying the views of Pippin, Allison, Bennett and Butts in an effort both to make sense of a difficult part of the Critique and to demonstrate that the Schematism is indeed where Kant demonstrates how the construction of empirical concepts in general is possible. -/- *In Chapter III, I discuss Brittan’s and Butts’ views on the nature of the specific construction of empirical concepts, defending Butts’ interpretation as compatible with Buchdahl’s view that gaps exist between kinds of lawlikeness for Kant and, because of its connection with an interpretation of how metaphysical lawlikeness figures in the Metaphysical Foundations of Natural Science, insofar as it helps us to establish the possibility of empirical lawlikeness and natural science. 'This collection confirms that Mary Shepherd is an unjustly neglected figure in modern philosopher. It will be especially interesting to students of Berkeley and Hume.' --David Raynor Very little is known about the life and work of Lady Mary Shepherd (1777--1847), and yet she is undoubtedly one of the most important women philosophers of the early modern period. Whewell is reputed to have used one of her books as a text at Cambridge, and Sir Charles Lyell said of her that (...) she was an 'unanswerable logician, in whose argument it was impossible to find a loophole or flaw'. Exceptionally well read and analytically clear, she made a significant scholarly contribution to the philosophical discussion and debate surrounding the work of Hume, Berkeley and others. This, the first modern edition of Shepherd's writings, includes her two major philosophical works: An Essay upon the Relation of Cause and Effect (1824), a critique of Hume's view of causality, and Essays on the Perception of an External Universe and Other Subjects (1827), a refutation of Berkeley's idealism. Also included is her first, anonymous, publication, Enquiry respecting the Relation of Cause and Effect (1819) and two shorter pieces. There is a growing interest in the contribution of women writers to the history of philosophy. However, limited access to original texts has prevented a serious and systematic examination of their doctrines. Shepherd's philosophical works deserve the careful consideration of contemporary historians and philosophers, but until now have been largely unavailable to the modern reader. A reevaluation of her works is long overdue and this new collection is a welcome addition to Thoemmes Press's list. --very rare works by an eminent and increasingly prominent woman philosopher of the Scottish Enlightenment. No single library in the world has all these works --available for the first time in a modern edition --includes critical reponses to leading figures of early modern philosophy --introduction with biographical detail on Shepherd and account of her works. Increasingly, professionalism has been recognized as a core competency for health service professionals and is the domain in which vexing competence problems are observed in trainees. We begin by describing manifestations of problems of professionalism in accord with the values that fall within the rubric of this multifaceted construct. We provide an approach for evaluating problems of professionalism and discuss intervention for trainees with mild, moderate, or severe problems in this domain. We propose implications for training focused on enhancing the (...) culture of programs; bolstering the education, guidance, and mentoring provided related to professionalism; and encouraging best practices for addressing trainees with problems of professionalism. We conclude by sharing ideas about defining professionalism, identifying problems of professionalism, strengthening our approach to assessing professionalism and intervening when problems are evident, developing strategies for preventing professionalism problems, and ensuring that psychologists take seriously their responsibility to address professionalism concerns with colleagues. In the neglected 'Amphiboly of the Concepts of Reflection,' Kant introduces a new transcendental activity, Transcendental Deliberation. It aims to determine to which faculty a representation belongs and does so by examining the representation's relationships to other representations. This enterprise yields some powerful ideas. Some of the relationships studied have great interest, numerical identity in particular. Indeed, seeing Kant discuss it here, one wonders why he did not include it in the Table of Categories. Despite the burgeoning literature on professionalism in other health professions, psychology lags behind in the level of attention given to this core competency. In this article, we review definitions from other health professions and how they address professionalism. Next, we review how this competency evolved within health service psychology (HSP), and we propose a definition. We offer an approach for assessing professionalism within HSP. Consideration is given to strategies and methods for providing effective education and training in this multifaceted competency. (...) We have the duty to object to things that people say. If you report something that I take to be false, unwarranted, or harmful, I may be required to say as much. In this paper, I explore how to best understand the distinctively epistemic dimension of this duty. I begin by highlighting two central features of this duty that distinguish it from others, such as believing in accordance with the evidence or promise‐keeping. In particular, I argue that whether we are (...) obligated to object is directly influenced not only by what other relevant members of the conversational context or community do, but also by the social status of the agent in question. I then show that these features are shared by the duty to be charitable, and the similarities between these two duties point to a potentially deeper explanation: while promise‐keeping is regarded as a classic perfect duty, charity is an imperfect one. I then argue that the duty to object can be modeled on a particular conception of imperfect duties, one that takes the duty to belong to communities and other collectives, rather than to individuals. I conclude by showing that this framework provides us with reason for accepting that there are imperfect epistemic duties in general. (shrink)

In this paper, I will argue that there is a deep connection between home-based care, technology, and the self. Providing the means for persons to receive care at home is not merely a kindness that respects their preference to be at home: it is an important means of extending their selfhood and respecting the unique selves that they are. Home-based technologies like telemedicine and robotic care may certainly be useful tools in providing care for persons at home, but they also (...) have important implications for sustaining selfhood in ways that are of value to individuals and those who care for them. I will argue, by appealing to Hilde Lindemann’s notion of “holding” persons’ identities in place, that technological interventions are not only useful tools for improving and sustaining health and good care at home, but that they may also help to extend our personal identities and relational capacities in ways that are practically and ethically good. Because of these important goods, I will claim that there is a prima facie moral duty to do this “holding” work and that it is best done by family members and loved ones who are well suited to the job because of their history and relationship with the individual that needs to be “held” in place. Decision-Making Capacity First published Tue Jan 15, 2008; substantive revision Fri Aug 14, 2020 In many Western jurisdictions the law presumes that adult persons, and sometimes children that meet certain criteria, are capable of making their own medical decisions; for example, consenting to a particular medical treatment, or consenting to participate in a research trial. But what exactly does it mean to say that a subject has or lacks the requisite capacity to decide? This question has to do with what (...) is commonly called “decisional capacity”, a central concept in health care law and ethics, and increasingly an independent topic of philosophical inquiry. -/- Decisional capacity can be defined as the ability of subjects to make their own medical decisions. Somewhat similar questions of capacity arise in other contexts, such as capacity to stand trial in a court of law and the ability to make decisions that relate to personal care and finances. However, the history behind the more general legal notions of capacity to stand trial and capacity to manage one’s life is different and operates somewhat differently in law (Roth, Meisel, & Litz 1977; Zapf & Roesch 2005). For the purposes of this discussion the notion of decisional capacity will be limited to medical contexts only; most notably, those where decisions to consent or to refuse treatment or participation in clinical research are concerned. There is a puzzle concerning the essences of fundamental entities that arises from considerations about essence, on one hand, and fundamentality, on the other. The Essence-Dependence Link (EDL) says that if x figures in the essence of y, then y is dependent upon x. EDL is prima facie plausible in many cases, especially those involving derivative entities. But consider the property negative charge. A negatively charged object exhibits certain behaviors that a positively charged object does not: it moves away from (...) other negatively charged objects, towards positively charged objects, etc. It is commonly thought that negative charge disposes its bearer to move away from other negatively charged objects, towards positively charged objects, etc. But if negative charge is fundamental, then no other entities—including the property positive charge—can figure in its essence. We thus have a prima facie puzzle: How can we say anything interesting about the essences of fundamental entities without running afoul of EDL? In this paper, I present and discuss the consequences of EDL for the debate between causal essentialists and quidditists about properties, and propose solutions to the puzzle. (shrink)

Properties seem to play an important role in causal relations. But philosophers disagree over whether or not properties play their causal or nomic roles essentially. Causal essentialists say that they do, while quidditists deny it. This article surveys these two views, as well as views that try to find a middle ground.

In humans, gender is both a concept and performance embodied by females and males, a corporeal technology that is produced dialectically. The process of gendering robots makes especially clear that gender belongs both to the order of the material body and to the social and discursive or semiotic systems within which bodies are embedded. This article explores and interrogates the gendering of humanoid robots manufactured today in Japan for employment in the home and workplace. Gender attribution is a process of (...) reality construction. Roboticists assign gender based on their common-sense assumptions about female and male sex and gender roles. Whereas the relationship between human bodies and genders is a contingent one, I argue that gendered robots render that relationship a necessary one by conflating bodies and genders. Humanoid robots are the vanguard of posthuman sexism, and are being developed within a reactionary rhetorical climate. (shrink)

Abstract: Practical deliberation is deliberation concerning what to do governed by norms on intention (e.g. means-end coherence and consistency), which are taken to be a mark of rational deliberation. According to the theory of practical deliberation I develop in this paper we should think of the norms of rational practical deliberation ecologically: that is, the norms that constitute rational practical deliberation depend on the complex interaction between the psychological capacities of the agent in question and the agent's environment. I argue (...) that this view does a better job of justifying particular norms for practical deliberation than intrinsic or constitutivist theories. Finally, I argue against the Myth Theory of deliberation, which takes there to be no such norms on deliberation. (shrink)

According to current definitions of civil disobedience, drawn from the work of John Rawls and Carl Cohen, eco-saboteurs are not civil disobedients because their disobedience is not a form of address and/or does not appeal to the public's sense of justice or human welfare. But this definition also excludes disobedience by a wide range of groups, from labor activists to hunt saboteurs, either because they are obstructionist or because they address moral concerns other than justice or the public weal. However (...) earlier definitions of civil disobedience were not so narrow. I review the development of the current definition and the circumstances of its acceptance. I argue that the circumstances which help to explain the attractiveness of the Rawls/Cohen formulations in the 1970s are no longer applicable and that the question of civil disobedience should be revisited. I suggest a wider definition according to which at least some types of eco-sabotage would be civil disobedience. (shrink)

The Federal Trade Commission has an important role to play in the governmental oversight of mobile health apps, ensuring consumer protections from unfair and deceptive trade practices and curtailing anti-competitive methods. The FTC’s consumer protection structure and authority is outlined before reviewing the recent FTC enforcement activities taken on behalf of consumers and against developers of mhealth apps. The article concludes with identification of some challenges for the FTC and modest recommendations for strengthening the consumer protections it provides.

This analysis connects the resurgence of affect theory known as “the affective turn” with the locus of attention surrounding abjection and examines the workings of abjection within the logics of disgust and shame, as well as the political potential of shame. The abject not only informs structures of knowledge and power that govern how subjectivities and group formations are founded and regulated, but provides elements of fluidity and ambiguity that allow us to challenge the affective patterns associated with the abject (...) and locate resources in shame that contribute to restructuring the terrain of politics beyond a simple conversion of shame to pride. Critical discourse analysis is a useful and productive qualitative methodology but has been underutilized within nursing research. In order to redress this deficiency the research presented in this article represents an exploration of the way in which critical discourse analysis may be applied to the analysis of public debates around policy for nursing practice. Carolyn McLeod's book is timely and important, especially when one considers the state of conscientious objection in a country like the United States. During his presidency, Donald Trump announced an expanded "conscience rule" for healthcare workers according to which they would have the protected right to morally and religiously oppose a variety of procedures, including abortion, sterilization, assisted suicide, and other medical procedures. In 2019, a number of states, local governments, and healthcare organizations brought lawsuits against the proposed rule, leading (...) a federal judge to reject it. In recent years there has been concern among law enforcement and national security organizations about the use of “anonymous” prepaid mobile phone service and its purported role in supporting criminal and terrorist activities. As a result, a number of countries have implemented registration requirements for such service. Privacy rights advocates oppose such regulatory measures, arguing that there is little practical value in attempting to register prepaid mobile devices, and the issue raises important questions about a citizen's entitlement to anonymity in (...) the ownership of a networked communications device. This article provides an overview of the issue and presents findings drawn from a recent study on prepaid mobile phone regulation in the Organisation for Economic Co-operation and Development countries. The article concludes by suggesting that there are significant problems with the claim that mandatory registration of prepaid mobile phone service is a necessary or an effective regulatory course of action. In this paper, I explore the implications of adopting one model of self rather than another in respect to one particular feature of our mental life. The need to explain synchronic unity in normal subjectivity, and also to explain the apparent and puzzling absence of synchronic unity in certain symptoms of severe mental disorder, I show, becomes more pressing with one particular model. But in the process of developing that explanation we learn something about subjectivity and perhaps also something about (...) brain functioning. (shrink)
